The KahunaCart affiliate program is run by Trilby Media, LLC ("we", "us"), the company that makes KahunaCart, at 3649 Evergreen Pkwy #502, Evergreen, CO 80439-9998, USA. These terms are the agreement between us and you, the partner. By applying to the program you agree to them. The terms of use for this site apply too.
Joining
Anyone can apply, from the application form or from the Affiliate tab of a kahunacart.com customer account. We read every application and decide whether to accept it. We can turn an application down without giving a reason, and each person and email address can apply once. If we accept you, your partner account lives in your kahunacart.com customer account: the one you already have with that email address, or a new one we make for you.
You need to be 18 or older, or older still if that's the age you can sign a contract where you live. The details you give us, including your tax details, have to be true and kept up to date.
You take part as an independent partner. Being in the program doesn't make you our employee, agent or representative, and you can't make promises or agreements on our behalf.
How a sale is credited to you
Once you're accepted, you get a referral link, a coupon code, or both. A sale is credited to you when:
- someone clicks your link and buys within 60 days of that click, or
- a customer enters your coupon code at checkout, whether or not they clicked a link.
When a customer clicked more than one partner's link, the last click before the purchase counts. When a customer clicked one partner's link and then entered another partner's coupon code, the coupon wins. Each order is credited to one partner at most.
The link works by storing a cookie in the visitor's browser. If the visitor blocks or clears it, or doesn't accept our marketing cookies, we may only be able to credit the sale for that visit or through your coupon. We can't credit a sale we can't trace back to your link or code, but we can credit one by hand when it's clear it came from you.
No self-referrals. Orders you place yourself, or that are placed for you or your business, aren't credited to you.
What you earn
You earn 30% of what the customer paid for a new purchase credited to you, such as a KahunaCart licence or an add-on. It's worked out after any discount, and before tax and shipping.
Licence renewals earn nothing. A renewal of a licence the customer already has isn't a new purchase, even when it's bought through your link.
If an order is refunded, in full or in part, or the payment is reversed by a chargeback, the commission on it is reduced or cancelled to match. This also applies after you've been paid: the amount is taken off your next payout, and your balance can go below zero until later commissions cover it.
When you're paid
Each commission is held for 30 days after the order is paid, so refunds can settle. After that it's ready to pay.
We pay once a month, to every partner whose ready-to-pay balance is $50 or more. A smaller balance carries over to the next month. Commissions and payouts are in US dollars.
You choose how to be paid on the Affiliate tab:
- Store credit on your kahunacart.com account, with 20% added. Store credit, bonus included, doesn't expire. It can be spent in our store only and can't be turned into cash.
- PayPal, to the PayPal email address you give us. PayPal's own fees and rules apply on your side. If you don't have a PayPal account yet, PayPal holds the payment for 30 days for you to claim it, and after that it comes back to your balance.
We don't pay by bank transfer or check.
A payment that fails or comes back, because of a wrong address or a closed account for example, goes back into your balance until you correct your details.
Tax forms
Before your first payout we need a tax form from you: a W-9 if you're a US person, or a W-8BEN (a W-8BEN-E for a company) if you're not. You fill it in on the Affiliate tab, and we can't pay you until it's on file and current.
KahunaCart collects and totals this information. It doesn't file tax returns or give tax advice. You're responsible for your own taxes on what you earn. If the law requires us to report payments to a tax authority, we will.
How you can promote KahunaCart
Recommend KahunaCart honestly, the way you'd recommend anything you use. These are not allowed:
- Bidding on our names in search ads. No paid search ads on "KahunaCart", "Grav", or misspellings or variations of them, and no ads that send people straight to our site through your link.
- Coupon and deal sites. Don't post your coupon code or link on coupon, deal, cashback or voucher sites.
- Spam. No unsolicited email, messages, comments or forum posts carrying your link or code.
- Pretending to be us. Don't present yourself as KahunaCart, Grav or Trilby Media, use domain names or social accounts that include our names, or suggest that we endorse you.
- Misleading claims. Don't make claims about KahunaCart's features, prices or performance that aren't on our own site, and don't promise discounts we don't offer.
You may use our names, logos and screenshots to talk about KahunaCart, as described on the brand assets page.
Telling people you're a partner
Say plainly, close to your link or code, that you earn a commission when someone buys through it. Follow the US Federal Trade Commission's guides on endorsements and testimonials, and the equivalent rules where you and your audience are.
Changes and closing an account
We can change these terms, including the commission rate, for sales made after the change. We'll email you at least 30 days before a change takes effect. Commissions earned under the old terms are honoured.
You can leave the program at any time by asking us. We can pause or close your account if you break these terms, or if we close the program.
When an account closes, the commissions you earned before that are still paid. Each one waits out its 30-day hold as usual, and the balance goes out with the next monthly payout even if it's under $50, as long as your tax form is on file. Commissions that came from breaking these terms can be cancelled instead.
Limits
The program is offered as it is. We aren't liable for lost sales, for sales we couldn't trace to you, or for indirect or consequential losses. Our total liability to you is limited to the commissions paid or owed to you in the 12 months before the claim. Nothing here limits any liability that the law doesn't allow us to limit.
You're responsible for what you publish, and you'll cover us for claims that come from your promotion breaking these terms or the law.
Law and disputes
These terms are governed by the laws of the State of Colorado, USA, without regard to its conflict of law rules. Any dispute about them or the program goes to the state courts in Jefferson County, Colorado, or the federal court for the District of Colorado, and you and we agree to those courts. Before going to court, please contact us first. Most things can be sorted out by email.
